By accessing this website, requesting a quote, placing an order, renting equipment, buying products, or using our online services, you agree to these Terms of Service.
These Terms apply together with any accepted quote, order confirmation, invoice, rental agreement, credit application, approved written specification, written warranty, and the customer reference pages linked from this website, including the Shipping Container Buying & Rental Guide. For a specific transaction, the accepted written quote, order confirmation, invoice, rental agreement, or approved written specification controls to the extent it is more specific, subject to any customer right that cannot legally be waived.
Website use
You may use this website only for lawful purposes. You must not misuse the site, interfere with its operation, attempt unauthorized access, transmit malicious code, scrape the site in a way that harms service quality, or use our products or services for illegal or unsafe purposes.
By using this site or placing an order, you represent that you are at least the age of majority in your province, state, or territory of residence, or that you have authority to act for the business or organization you represent.
Products, services, and availability
The Container Guy sells, rents, delivers, modifies, and services industrial products, including shipping containers, rental units, offices, site shacks, specialty containers, parts, accessories, and related services. Availability, condition, pricing, delivery, pickup, rental options, modification options, and buyout options depend on branch inventory, site access, customer requirements, supplier availability, and written approval.
Product photos, renderings, dimensions, descriptions, grades, colours, layouts, and examples are provided for general reference. Containers are industrial steel products and may vary by grade, age, origin, manufacturer, prior use, repairs, markings, paint, dents, surface corrosion, handling marks, and normal wear unless a specific written specification has been approved.
We may limit quantities, refuse service, decline an order, cancel an order before acceptance, correct an error, or discontinue a product or service where reasonably necessary. If an order is affected, we will try to contact you using the information provided.
Pricing, quotes, and payment
Prices are shown in Canadian dollars unless stated otherwise. Taxes, delivery, pickup, freight, customs, brokerage, special equipment, handling, deposits, rental charges, recurring charges, accessories, modifications, and other order-specific charges may apply as shown at checkout or in the accepted quote, invoice, rental agreement, or written order confirmation.
Published prices, availability, and product information may change without notice. If a price, description, image, availability status, shipping charge, or other site detail is inaccurate, we may correct it before accepting or completing the order. An online submission, quote request, or checkout action does not require TCG to supply a product or service until the order is accepted by TCG.
Deposits, progress payments, recurring rental charges, payment authorization, credit terms, late charges, and collection rights may be set out in the quote, invoice, rental agreement, credit approval, or other written terms for the transaction.
Delivery, pickup, and site access
Container delivery and pickup are heavy-equipment work. Customers are responsible for accurate site information, safe access, prepared ground, required permissions, permits, traffic control, and a reachable site contact unless TCG agrees otherwise in writing.
Drivers may refuse, delay, or adjust a placement if site conditions, weather, ground conditions, clearance, traffic, customer instructions, or surrounding property create an unreasonable risk. Additional charges may apply for failed delivery, failed pickup, waiting time, redelivery, return-to-yard costs, special equipment, recovery, cleaning, disposal, damage, or customer-caused delays.

Rentals and purchase options
Rental terms, billing, deposits, payment authorization, pickup readiness, customer property, insurance, damage responsibility, and any purchase option or buyout credit must be handled according to the rental agreement and any written approval from TCG. Rental containers are not automatically available for sale.

Returns, cancellations, refunds, buybacks, and trade-ins
Containers, modified containers, specialty units, offices, site shacks, pre-engineered builds, custom work, fabricated parts, installed parts, altered parts, special-order items, and committed orders may be final sale or subject to reasonable order-specific costs once reserved, prepared, released, picked up, dispatched, delivered, modified, or otherwise committed to the customer order.
Approved refunds are usually issued to the original payment method unless TCG agrees otherwise in writing. Banks and payment processors may take additional time to post refunds. Buybacks, trade-ins, and swaps are separate negotiated transactions and are not returns or refunds.

Modified containers, custom work, and specifications
Modified units and pre-engineered builds may involve design work, materials, fabrication, electrical components, HVAC, doors, windows, paint, coatings, insulation, scheduling, yard handling, transportation, and third-party services. Changes requested after approval may affect price, timing, deposit treatment, warranty, and delivery.
Customers are responsible for reviewing and approving written specifications, drawings, quotes, layouts, product selections, and site requirements before work proceeds. Building code, permitting, engineering, utility connection, anchoring, and site-specific compliance are the customer's responsibility unless TCG specifically agrees otherwise in writing.
Parts, accessories, and installation
Parts and accessories must be selected, installed, wired, handled, and used safely and lawfully. Customers are responsible for confirming fitment, measurements, intended use, site conditions, and whether qualified trades are required. Electrical, structural, lifting, hazardous-material, or regulated work should be performed by qualified people where required.
Third-party tools, links, and services
This website may include third-party tools, payment services, embedded apps, product links, maps, videos, forms, shipping providers, supplier-direct items, or links to third-party websites. These third parties are not controlled by TCG. Your use of third-party services may be subject to their own terms and privacy practices.
Accounts and customer information
You agree to provide current, complete, and accurate account, billing, shipping, delivery, site, payment, and contact information. You are responsible for keeping account credentials secure and for activity under your account where the activity results from your failure to protect those credentials.
Intellectual property and feedback
The website, brand names, images, videos, text, product layouts, designs, graphics, and other content are owned by TCG or used with permission. You may not copy, reproduce, publish, sell, or exploit website content without written permission except for ordinary personal or internal business reference related to a TCG purchase, rental, quote, or inquiry.
If you send feedback, ideas, photos, reviews, or suggestions, you grant TCG permission to use them for business purposes unless we have agreed otherwise in writing or the content contains personal information handled under our Privacy Policy.
Privacy
Personal information submitted through the website or in connection with an order is handled according to our Privacy Policy.
Errors, omissions, and site availability
We try to keep the website accurate and available, but errors, omissions, delays, outdated information, technical problems, or interruptions may occur. We may correct site information, update content, suspend features, or change the website without notice.
Limitation of liability
To the maximum extent permitted by law, TCG is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of revenue, business interruption, loss of stored goods, loss of use, or delay-related losses arising from website use, third-party services, product selection, delivery, pickup, rental use, site conditions, or customer instructions.
Nothing in these Terms excludes responsibility that cannot legally be excluded, including responsibility for direct damage caused by TCG or its carrier failing to exercise reasonable care where applicable.
Indemnity
You agree to indemnify and hold TCG harmless from claims, costs, losses, damages, and expenses arising from your breach of these Terms, unlawful use of the website or products, inaccurate site or order information, undisclosed hazards, lack of required permission, customer-selected placement after a driver warning, unsafe or unauthorized use, or content you submit, except to the extent caused by TCG's own negligence or responsibility that cannot legally be excluded.
Governing law
These Terms and any related website use are governed by the laws of Saskatchewan and the applicable laws of Canada. Courts located in Saskatchewan will have jurisdiction unless applicable consumer protection law requires a different forum or governing law.
Changes to these Terms
We may update these Terms by posting a revised version on this page. The version posted at the time of an accepted order may apply to that order unless the parties agree otherwise in writing or a customer right cannot legally be waived.
